Privacy Policy

Last updated: 23 October 2026

Davis + Haven Legal (“we”, “us”, “our”) is committed to protecting the privacy of personal information we collect, hold and handle. This Privacy Policy explains how we comply with our obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. What is personal information?

“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not. Examples include your name, address, email address, telephone number, date of birth and bank account details.

“Sensitive information” is a subset of personal information that includes health information, genetic information, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, and criminal records.

2. What personal information we collect

The types of personal information we collect depend on the services we provide to you. This may include:

  • Identification information — name, date of birth, government-issued ID details where required for identity verification
  • Contact details — address, phone, email
  • Financial information — bank account details, income details relevant to your matter
  • Property information — details of real estate you are buying, selling or holding
  • Family and estate information — details of family members, beneficiaries, executors, dependants (as relevant to wills, probate and estate matters)
  • Correspondence — letters, emails, notes of meetings and phone calls between you and us
  • Website usage information — IP address, browser type, pages visited (collected automatically when you use our website)

3. How we collect personal information

We collect personal information:

  • Directly from you — when you contact us, complete a form on our website, book a chat, engage us for legal services, or send us correspondence
  • From third parties — such as other lawyers, courts, government agencies, PEXA, Land Use Victoria, Infotrack, your mortgage broker, accountant, or financial institution, with your consent or where required by law
  • Automatically — from our website using cookies and analytics tools (see Section 10 below)

4. Why we collect personal information

We collect, hold, use and disclose personal information to:

  • Provide you with legal services and advice
  • Comply with our obligations as Australian legal practitioners, including identity verification, trust account administration, anti-money laundering obligations, and continuing professional duties
  • Communicate with you and manage our relationship
  • Issue invoices and manage payments
  • Comply with legal, regulatory and professional obligations
  • Improve our services and website
  • Send you relevant information about our services (where you have consented to this)

5. How we use and disclose personal information

We only use and disclose personal information for the purposes for which it was collected, or for related purposes you would reasonably expect, or with your consent. In the course of providing legal services, we may disclose your personal information to:

  • Other parties involved in your legal matter — such as the other side’s lawyer, courts, tribunals, government agencies, Land Use Victoria, PEXA, title offices and the Australian Taxation Office
  • Service providers who assist us to run our practice — such as our IT providers, document management systems, banking providers, and accounting services
  • Our professional indemnity insurer, auditors and regulators (including the Legal Services Board of Victoria)
  • Your other advisers — such as your accountant, financial planner or mortgage broker — with your consent

We do not sell personal information to third parties for marketing purposes.

6. Disclosure overseas

Some of our service providers may store or process personal information outside Australia (for example, cloud-based email, document management and video conferencing services). Where this occurs, we take reasonable steps to ensure your personal information is protected to a standard comparable with the APPs.

7. Storage and security

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps include secure digital storage, access controls, staff training, and physical security of our premises.

We retain personal information for as long as is reasonably necessary to provide our services, comply with our legal and professional obligations (including document retention requirements for legal practitioners), resolve disputes and enforce our agreements. When personal information is no longer needed, we take reasonable steps to destroy or de-identify it.

8. Accessing and correcting your personal information

You have the right to request access to the personal information we hold about you and to request that it is corrected if it is inaccurate, out of date, incomplete or misleading. To make a request, please contact us using the details in Section 12 below. We will respond within a reasonable time, usually within 30 days.

There may be circumstances where we are not able to provide access — for example, where the information relates to another person, is subject to legal professional privilege, or is otherwise exempt under the Privacy Act. If we refuse access, we will explain our reasons in writing.

9. Direct marketing

We may use your personal information to send you information about our services that we think may be of interest to you. You can opt out of receiving marketing communications at any time by clicking the “unsubscribe” link in any email we send you, or by contacting us using the details in Section 12.

You can configure your browser to refuse cookies, however some parts of our website may not function correctly as a result. For more information about Google Analytics, visit the Google Privacy Policy.
